Vocary Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Vocary mobile application, website located at https://getvocary.com, and related services (collectively, the “Services”) operated by Benjamin Hansen trading as Vocary (“Vocary”, “we”, “us”, or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.


1. Eligibility

You must be at least 13 years old to use the Services.

If you are under 18 years old, you confirm that you have permission from a parent or legal guardian to use the Services and agree to these Terms.

You may only use the Services in compliance with applicable laws and regulations.


2. About Vocary

Vocary is a vocabulary learning platform designed to help users discover, save, organise, review, and learn English words through personalised learning systems, spaced repetition, progress tracking, and related educational tools.

Features and functionality may change over time.


3. User Accounts

To access certain features, you may be required to create an account.

You agree to:

·         provide accurate and complete information;

·         maintain the security of your account credentials;

·         keep your login information confidential; and

·         notify us immediately of any unauthorised use of your account.

You are responsible for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.


4. Acceptable Use

You agree not to:

·         use the Services for unlawful purposes;

·         copy, scrape, reverse engineer, or exploit the Services;

·         interfere with the operation or security of the Services;

·         upload malicious code or harmful content;

·         use bots, scripts, automation tools, or other methods to artificially manipulate streaks, XP, rankings, engagement, or usage metrics;

·         sell, transfer, or share your account without permission;

·         attempt to gain unauthorised access to systems or accounts; or

·         use the Services in a way that could damage Vocary or other users.

We may suspend or terminate access for violations of these Terms.


5. User Content

You may create, save, upload, or submit content through the Services, including saved words, notes, learning lists, usernames, profile information, and other materials (“User Content”).

You retain ownership of your User Content.

By submitting User Content, you grant Vocary a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, and display that content solely for the purpose of operating and improving the Services.

You are solely responsible for your User Content and confirm that:

·         you own or have the rights to the content;

·         the content does not violate laws or third-party rights; and

·         the content does not contain harmful, offensive, or unlawful material.

We reserve the right to remove User Content at our discretion.


6. AI-Generated Content

Some features of the Services may use artificial intelligence or third-party AI systems to generate explanations, definitions, examples, learning content, or recommendations.

AI-generated content may occasionally contain inaccuracies, omissions, or outdated information.

The Services are provided for educational and informational purposes only. You should not rely exclusively on AI-generated content for academic, professional, legal, medical, or other critical purposes.

We make no guarantees regarding the accuracy, completeness, or reliability of AI-generated outputs.


7. Subscriptions and Payments

Vocary may offer paid subscriptions, premium features, and free trials.

Subscriptions may renew automatically unless cancelled before the renewal date.

Subscription pricing, features, and billing intervals may change over time.

Payments processed through Apple App Store, Google Play, or other third-party platforms are subject to those platforms’ billing terms and policies.

By purchasing a subscription, you authorise the applicable platform to charge your selected payment method.


8. Free Trials

Vocary may offer free trial periods for premium subscriptions.

Unless cancelled before the trial period ends, your subscription may automatically convert into a paid subscription and your payment method may be charged.

You are responsible for managing or cancelling subscriptions before renewal if you do not wish to continue.


9. Refunds

Refund requests may be handled according to:

·         applicable Australian consumer laws;

·         Apple App Store policies;

·         Google Play policies; and

·         other applicable payment provider policies.

Certain purchases may be non-refundable except where required by law.


10. Intellectual Property

The Services, including all software, branding, designs, logos, graphics, interfaces, content, text, databases, and functionality, are owned by or licensed to Vocary and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, licence, reverse engineer, or exploit any part of the Services without prior written permission.

“Vocary” and associated branding may not be used without authorisation.


11. Third-Party Services

The Services may integrate with or rely on third-party services, platforms, or providers, including:

·         Apple App Store;

·         Google Play;

·         Firebase;

·         OpenAI;

·         RevenueCat; and

·         analytics or infrastructure providers.

We are not responsible for third-party services, websites, policies, or practices.

Your use of third-party services may be subject to their own terms and policies.


12. Privacy

Your use of the Services is also governed by our Privacy Policy available at:

13. Service Availability

We aim to provide reliable access to the Services but do not guarantee uninterrupted availability.

The Services may be modified, suspended, discontinued, or updated at any time without notice.

We are not liable for downtime, interruptions, bugs, data loss, or feature changes.


14. Termination

We may suspend or terminate your access to the Services at any time if:

·         you violate these Terms;

·         your use creates legal or operational risk;

·         fraudulent or abusive activity is suspected; or

·         required by law.

You may stop using the Services at any time.

Subscription cancellations must be managed through the applicable app store or payment platform.


15. Disclaimers

The Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Vocary disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability.

We do not guarantee that:

·         the Services will be error-free;

·         content will always be accurate or complete;

·         the Services will be secure or uninterrupted; or

·         learning outcomes will be achieved.


16. Limitation of Liability

To the maximum extent permitted by law, Vocary and Benjamin Hansen will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Services.

Where liability cannot be excluded, our total liability is limited to the greater of:

·         the amount paid by you to Vocary in the six (6) months prior to the event giving rise to the claim; or

·         any minimum amount required under applicable law.

Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.


17. Indemnity

You agree to indemnify and hold harmless Vocary, Benjamin Hansen, affiliates, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

·         your use of the Services;

·         your User Content;

·         your violation of these Terms; or

·         your violation of laws or third-party rights.


18. Copyright Complaints

If you believe content on the Services infringes your copyright or intellectual property rights, you may contact:

Please include sufficient details to identify the allegedly infringing material and your claim.


19. Changes to These Terms

We may update these Terms from time to time.

If material changes are made, we may notify users through:

·         email notifications;

·         in-app notifications; or

·         updates published on our website.

Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.


20. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any disputes arising from these Terms or the Services will first attempt to be resolved through informal negotiations for at least 30 days.

If unresolved, disputes may be resolved through arbitration or courts located in Melbourne, Victoria, Australia.

Proceedings will be conducted in English.

22. Entire Agreement

These Terms, together with our Privacy Policy and any additional policies referenced within the Services, constitute the entire agreement between you and Vocary regarding your use of the Services.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
